delCapo attended the DAP organised forum at Chinese Assembly Hall last nite.
On the Panel:
- Ms Sonya Liew (Bar Council) – gave us the Bar Council’s objections to the various parts of the current draft and their efforts to try & recommend changes to the draft.On a personal level. On a personal note, she urged the public to think about how the Bill will affect us, and our future generations if we don’t make sure it is of any fair standards.
- Dr Koh Chong Lek (DNA Centre NIE/NTU Singapore) – who is a concerned Malaysian, gave the forum detailed insight into what it means to have DNA as evidence for cases. He also listed out the questionable areas & the flaws in the current draft from referenced (to other countries’ parctises) and acedemic points of view.
- Gobind Singh DEO- who is the lead among the opposition in raising questions on the current draft, gave us detailed insight into the legal implications of the various sections of the current draft, including how it is a politically motivated move to pass this Bill quickly. (delCapo agrees… they might as well call it DSA(I) Bill)
- YB Lim Kit Siang – the DAP stalwart told us that we the rakyat, the civil societies must support the bar council & PR in an all out effort to pressure BN government to withdraw the current Bill and set up an independent, all-rounded committee to redraft the Bill. Also, a data Protection Act should be in place first.
Status wise – The Bill has gone through 2 sittings in Parliament and will be tabled one last time in December before it will be passed. AND it WILL be passed, regardless of how much the opposition MPs and the BN MPs may object & raise concerns of it. BN has majority in government, & operates a whip system when it comes to voting… that’s just the way it is.
The scariest part is that what’s in the Bill in it’s current form is so flawed, one sided & dangerous for ALL citizens who might have the most minor of brushes with the Law (including speeding cases).
Conclusion:
– A DNA Act of some sort, in good form, is a good legislation to aid law enforcement and Judiciary process when it comes to evidence. No doubt.
– The current Bill by BN under Minister Botak has sections and clauses that should scare the shit out of us (including himself if he ever gets investigated for any case)…. e.g section 13(7) allows taking of sample by the police using “any means”, sec.24 spells that the DNA evidence shall be conclusive & cannot be challenged… sec.27 allows all old DNA samples & data to be included in the databank!!…. the databank shall be in custody of the Police, who can only be instructed by the Home Minister …. [i dunno about u, but thats fucken scary]
– It is a Bill that violates privacy and human rights and has not comprehensively covered on procedures and security of data.
– We must stop it. We must support all the efforts by Bar Council, PR and civil societies to influence & pressure BN to withdraw it in it’s current form.
If we cannot stop it, & PR doesn’t come to power…. the government will not need ISA anymore…. they can get anyone they want, as & when they want using the DNA Act…..
So here’s delCapo’s question to PR…. tell us what we can do during this ONE month left before the Bill is to be passed in Parliamant.
